Terms of Service

1. Acceptance of Terms
By downloading, installing, accessing, or using the Habit Bank mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. App Character and Purpose
Important Notice:
The Habit Bank application is exclusively of entertainment and motivational character. All point values ("coins", "points", "goals") are fictional and have no correlation to real money or right to withdrawal. The goal and penalty system serves only to build habits and is not in any aspect a game of chance, gambling, or betting - users cannot lose real money in any way nor win real value.
3. Free and Pro Access
The App is free to download and use. Certain features are available only with a Habit Bank Pro subscription or one-time purchase (collectively, "Pro").
3.1 Free Tier
The free tier includes the following limitations:
- Maximum of two (2) active (non-archived) habits.
- Statistics history limited to the current month and the immediately preceding month; older months and the Yearly progress tab require Pro.
- Holiday Mode (which suspends penalty processing during vacations or breaks) is a Pro feature and is disabled on the free tier.
- All other core features — including habit completion tracking, goals, local notifications, points/penalty system, and existing data — remain available.
3.2 Pro Tier
Pro unlocks the following features:
- Unlimited active habits.
- Full statistics history (all months, yearly heatmaps and analytics, all charts).
- Holiday Mode.
- All visual progress views, heatmaps, and advanced statistics.
3.3 Pro Purchase Options
Pro is offered through the following options:
- Monthly subscription — an auto-renewable subscription billed every month.
- Yearly subscription — an auto-renewable subscription billed every twelve (12) months, typically at a reduced effective monthly rate.
- Lifetime — a one-time, non-consumable in-app purchase granting Pro for the lifetime of the App on the purchasing Apple ID.
All three options unlock the same Pro entitlement. Current prices, currencies, and applicable taxes are displayed in the App at the moment of purchase and may vary by territory and over time.
4. Auto-Renewable Subscriptions
The following terms apply to the Monthly and Yearly subscriptions ("Subscriptions"):
- Billing: Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-Renewal: Your Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Renewal Charge: Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period, at the price disclosed at the time of the original purchase (or at any updated price you have accepted).
- Price Changes: If the renewal price of a Subscription increases, Apple will notify you and ask for your consent before the next renewal in accordance with Apple's policies. If you do not consent, the Subscription will not renew at the new price.
- Managing or Cancelling: You can manage your subscription and disable auto-renewal at any time in your Apple ID account settings (Settings → [your name] → Subscriptions on iOS). Cancellation takes effect at the end of the then-current paid period; Pro remains active until that date.
5. Lifetime Purchase
The Lifetime option is a one-time, non-consumable in-app purchase. It does not auto-renew and is tied to the Apple ID used to make the purchase.
What "Lifetime" means: the term refers to the lifetime of the App itself, not to the user's lifetime. It means the period during which Habit Bank remains available on the Apple App Store and is supported by the developer. It does not constitute a guarantee of perpetual availability of the App, its updates, its servers, or of any third-party platforms (such as Apple or RevenueCat) on which the App depends. If the App is permanently discontinued, Lifetime users will retain the App on their device for as long as Apple permits and to the extent technically possible, but no ongoing service obligation arises from the Lifetime purchase beyond what is mandated by applicable consumer protection law.
6. Billing, Restore Purchases and Refunds
- Biller: All purchases and Subscriptions are processed by Apple Inc. through the App Store, in accordance with the Apple Media Services Terms and Conditions. Habit Bank does not process or store your payment information.
- Entitlement Provider: Habit Bank uses RevenueCat, Inc. to verify your purchase receipts with Apple and to determine your Pro entitlement state. See our Privacy Policy for details on data processing.
- Restore Purchases: If you have previously purchased Pro and reinstall the App or switch devices using the same Apple ID, your entitlement is restored automatically. A manual "Restore Purchases" control is also provided in the App.
- Refunds: Refund requests for App Store purchases and Subscriptions are handled by Apple and are subject to Apple's policies. Habit Bank cannot issue refunds directly. To request a refund, use reportaproblem.apple.com.
7. EU/EEA Right of Withdrawal
If you are a consumer in the European Union or European Economic Area, you normally have a 14-day right of withdrawal for digital content purchases. By starting to use Pro immediately upon purchase, you expressly consent to the immediate performance of the contract and acknowledge that you thereby lose your statutory right of withdrawal for the digital content delivered. This does not affect any statutory warranty rights or mandatory consumer protections in your jurisdiction. Refunds remain handled by Apple under its policies.
8. Legacy Users (Previously Paid Versions)
Habit Bank was previously offered as a paid, one-time-download app. Users who originally purchased the App at version 1.1.2 or earlier are granted lifetime Pro access at no additional cost. The App reads the original App Store receipt on launch via Apple's StoreKit; if the original application version is 1.1.2 or earlier, the lifetime Pro entitlement is granted automatically. No account, login, or manual restore is normally necessary.
If the automatic grant fails (for example, because the App Store receipt is unavailable on a new device or could not be validated), you can use the "Restore Purchases" control in the App. If the issue persists, please contact us at habitbank0@gmail.com with the Apple ID used for the original purchase, and we will work to restore the entitlement.
9. Downgrade and Data Preservation
If your Pro entitlement ends (for example, you cancel and your paid period expires), Habit Bank applies a graceful downgrade:
- No data is deleted. All of your habits, completions, goals, and historical statistics are preserved on your device.
- Your two (2) oldest active habits (by creation date) remain fully editable under the free tier.
- Your additional active habits become read-only. You can still check or uncheck days for them and their existing notifications and penalty processing continue to operate; however, editing or deleting them requires re-activating Pro.
- Pro-only views (Yearly tab, older history months, Holiday Mode) are again gated behind the paywall but the underlying data is retained.
- Re-subscribing or repurchasing Pro at any time fully unlocks all habits and features with no data loss.
10. Virtual Points Disclaimer
- Fictional Nature:
All virtual currency, points, coins, and goals within the App are entirely fictional and hold no real-world monetary value. Points are solely a progress tracking mechanism. - No Real Money Value:
Users cannot exchange, withdraw, redeem, or convert Points or virtual currency for real money, goods, or services of any kind. Points have zero monetary value and cannot be cashed out, withdrawn, or converted to any form of real currency or tangible benefits outside the App. - Goals Are Not Payable:
Personal goals created by users within the App are self-defined motivational targets only. The App does not provide, deliver, or pay out any goals. Users are responsible for fulfilling their own self-defined goals, and Habit Bank has no obligation or liability related to user-created goals. Goals cannot be withdrawn, paid out, or claimed from the App or its operator in any way. - Point Symbols:
The App uses non-currency point symbols (e.g., PTS, XP, GEMS, ★, ✦, ◆) to label Points. The App does not use ISO currency codes (such as USD, EUR, PLN) or any currency sign to represent Points. These symbols serve exclusively as visual labels for Points, do not reflect any real-world currency or exchange rate, and cannot be exchanged for real money. They are purely graphical elements to enhance user experience. - No Gambling or Betting:
The App does not constitute gambling, betting, or any form of game of chance. No real money transactions occur within the App in connection with Points. Users cannot win or lose real money through Points. - Points Are Not For Sale:
Virtual Points are not the subject of any in-app purchase. Pro subscriptions and the Lifetime purchase described in these Terms grant access to App features only; they do not purchase, convert into, or otherwise relate to Points, and they cannot be traded or transferred between users.
11. Data and Privacy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices, including what limited information is processed by Apple and RevenueCat in connection with purchases and Pro entitlement.
12. Intellectual Property
The App and its original content, features, and functionality are owned by Habit Bank and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
13. Disclaimers and Limitation of Liability
- No Warranties:
The App is provided "as is" without warranties of any kind, either express or implied. - Limitation of Liability:
To the maximum extent permitted by applicable law, Habit Bank shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our aggregate liability for any claim relating to the App shall not exceed the total amount, if any, you paid to access Pro features in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable mandatory consumer protection law in your country of residence. - Entertainment Purpose:
While the App is designed to support habit development, we do not guarantee specific outcomes or improvements in behavior. - Third-Party Availability:
Pro functionality depends on the continued operation of third-party services (Apple App Store, RevenueCat). We are not liable for outages or changes in those services that temporarily affect entitlement verification.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time. Material changes affecting paid features will be communicated within the App or via the App Store listing. Your continued use of the App after a change becomes effective constitutes acceptance of the revised Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-law rules. The courts having jurisdiction over the seat of the operator (Pawel Konieczny, sole proprietor, Poland) shall have jurisdiction over any dispute arising from or related to these Terms.
EU/EEA consumers: nothing in this clause deprives you of the protection of the mandatory consumer-protection provisions of the law of the country in which you have your habitual residence (Article 6 of Regulation (EC) No 593/2008, "Rome I"). You may also bring proceedings against us in the courts of your country of residence in accordance with applicable EU consumer rules.
16. Online Dispute Resolution (EU)
Pursuant to Regulation (EU) No 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform for consumers resident in the EU: https://ec.europa.eu/consumers/odr. We are not obliged to and do not commit to participate in alternative dispute resolution proceedings before a consumer arbitration board, but you are free to use the ODR platform.
